Supplemental rule aims to implement Sackett decision
The EPA’s request for additional public comments reflects the legal complexity of a water rule that has been litigated for decades and reached the Supreme Court twice since 2006. The supplemental rulemaking will help the agency and the U.S. Army Corps of Engineers evaluate a wider range of options as they work toward a final rule that fully implements the Supreme Court’s 2023 Sackett decision.
