Masked Agents and One-Minute Notice on Tohono O'odham Land After a Federal Court Relies on Government Promises

  • A ProPublica investigation documents a mismatch between the consultation assurances DOJ attorney Adam R.F. Gustafson gave U.S. District Court Judge Richard J. Leon before his Aug. 14 denial of the Tohono O'odham Nation's injunction and the conduct within eleven days—including masked BORTAC agents, a one-minute Border Patrol notice to Chairman Verlon Jose, contractors working beyond the promised 60-foot zone, and a celebratory "Resistance Is Futile" meme from DHS General Counsel James Percival.
  • Beyond the Aug. 25 incident, the documented operational record includes the April bulldozing of the 6,500-year-old Las Playas Intaglio site two days after DHS Secretary Markwayne Mullin told tribal leaders "Don't mess with me," and an alleged warning from CBP Commissioner Rodney Scott that litigation could cost the nation access to three border gates used for cross-border travel.
  • The Nation's June 16 federal lawsuit framed the proposed 62-mile wall as a "reduction" of its reservation—an act the tribe argued only Congress, under Article I, could authorize, against the structural premise of federal-tribal law that the sovereignty of recognized nations predates the Constitution.

Senate sergeant-at-arms framework excludes agentic AI tools pending unspecified vetting

Illustration accompanying article: Senate staff restricted to basic AI tools as Congress debates regulation
  • The Senate sergeant at arms has authorized three basic chat interfaces for staff use while barring agentic tools, and external analyses attribute the resulting capability gap to blame-avoidance incentives in a single-approver architecture that operates without a published vetting timeline.
  • Daniel Schuman of the American Governance Institute characterized the sergeant-at-arms position as reflecting an institutional incentive to "put the brakes on most things" rather than a calibrated security judgment, while acknowledging that data-exfiltration concerns are real but not unique to advanced AI tools.
  • Adam Kovacevich of Chamber of Progress characterized the restrictions as "pretextual objections," arguing that Fortune 500 firms use the same tools successfully with sensitive customer data.
  • Sen. Bernie Moreno, R-Ohio, disclosed an ad hoc workaround — an AI "staffer" named Albert — that the sergeant-at-arms vetting process does not currently address, indicating uneven adherence across offices.
