Jury rejects design defect, fraud and negligence claims by three plaintiffs
Bayer said late Thursday that a Missouri Circuit Court jury ruled for its Monsanto business on the design defect, fraud, and negligence claims that each of the three plaintiffs pursued. The claims concerned the company’s Roundup weedkiller.
The verdict hands Bayer a win in the first trial over Roundup since the U.S. Supreme Court ruled in its favor in June. Bayer won that challenge against claims that it failed to warn consumers that Roundup causes cancer.
The claims at trial were distinct from the failure-to-warn claims the Supreme Court addressed in June. Bayer is pursuing a $7.25 billion settlement as part of a plan to move past the long-running legal battles over the weedkiller.
The company said it would continue to back the safety of its glyphosate-based herbicides and defend its products in any remaining litigation.
