On Wednesday evening a federal judge — Bill Clinton put him on the bench, very biased, people are saying it — said NO to us. Judge David Carter denied the request to set aside the ballots of 20,000 people my Justice Department says are non-citizens, and he did it two weeks after we handed Los Angeles and Sacramento a USB drive with the names on it and a BEAUTIFUL 48-hour deadline: review the list, or we sue (that deadline was a work of art, I drafted it myself, very smart, very fast). He said no to the deadline. SAD!

Now they’re telling you the list was wrong. Los Angeles officials found “preliminary indicators” — PRELIMINARY, low IQ, nobody even knows what that means — and county officials found flagged names of people who weren’t even on the rolls, and said we didn’t supply enough information to verify anyone’s citizenship. In other words the list was so good they couldn’t find the people ON it. That’s not a flaw, that is HIDE AND SEEK, and they are winning at it, which is exactly why the ballots should have been set aside. So we sued on October 15 rather than sit around being polite. Day one! Politeness is a mistake, my father never made it, and neither do I.

Carter wrote that “This case is about the right of every American citizen to vote in a free and fair election” — yes, EVERY citizen, that is precisely my point, every citizen, read it again, they never give me credit for reading it first — and that “Never before in American history has the federal government, on the eve of an election, sought to coerce a state and local government to abandon their own Constitutional elections procedures.” Never before! He is describing ME. There is nobody else it could be about. Then he said the Executive would have the Court believe “it reigns as a sole sovereign,” but “California and its people are sovereign, too.” Fine. Two sovereigns. But only one of them showed up with a USB drive, and it was not California.

When he set an October 27 hearing (part of a dispute that predates this whole emergency) we did not wait for him — we went to the Ninth Circuit and said he was moving too slowly, because I move FAST, TREMENDOUS speed, ask anyone, and a panel ruled against us 2-1. Two to one! One judge away. That is not a loss, that is a MARGIN, and margins are how you know you were close. Also in July Homeland Security announced there were up to 190,000 non-citizens on California’s rolls — I said it, first, long before anyone else, my uncle the great MIT professor could have told you the same thing, lists are a smart-person problem — and the details did not arrive until after the ballots had already gone out. The Guardian reports legal experts think the whole approach “appeared designed to cast doubt over the results of the midterms.” DESIGNED! They are crediting me with designing the entire midterms. My department separately threatened to prosecute California officials for tabulating the ballots, and a former prosecutor named Sam Trepel said that would be without legal basis — very nice man, very nice, low energy perhaps, and nobody asked him.

California has more than 23 million registered voters and they say non-citizen voting is “extremely rare.” EXTREMELY rare is not NEVER — it is rare the way my rally crowds are described as rare, meaning enormous. So we reissue the list. Bigger, cleaner, more information this time — ALL the information, the most information, more information than any list in history — with a 24-hour deadline, because 48 hours was generous. I am a GENEROUS person. Some say too generous. They were still late.

The truth is this was never about 20,000 names. It is about who runs the Country, and the smart people — the very smart people, the BEST people — are saying the answer is me. A Clinton judge said no and it took him two weeks and a Ninth Circuit panel to do it, which is a lot of effort for a bad list: you don’t threaten officials, you don’t appeal, you don’t claim 190,000, over a list you don’t believe in. You do all of that because the list is right and they know it. The beautiful voters of California — the biggest, most TREMENDOUS voters anyone has ever seen, more voters than Lincoln had, the historians are saying it — they are with me, though why they’re with me I couldn’t tell you, honestly, nobody could, it is a mystery, a tremendous mystery, and I will be back in court Monday, bigger than ever, mostly me.
