  • A California appeals court on Friday upheld Harvey Weinstein's 2022 rape and sexual assault conviction but ordered the trial judge who imposed a 16-year sentence to resentence him.
  • The three-judge panel from California's 2nd District Court of Appeal unanimously rejected Weinstein's attempts to overturn the verdict, writing that "We reject his attempts to disturb the jury's guilty verdicts."
  • Weinstein spokesperson Juda Engelmayer said the defense was disappointed with the decision but acknowledged the court correctly recognized that the sentence could not stand.
  • The ruling came a day after New York prosecutors dropped the remaining rape charge against Weinstein after the accuser said she could not bear to testify again.

  • Mann said in a statement that the mistrial does not detract from the truth she told and that she deserves justice, and Manhattan District Attorney Alvin Bragg said prosecutors will consult her before deciding next month whether to retry the case.
  • Weinstein has already been convicted of sex crimes in New York and Los Angeles and remains imprisoned; the deadlocked charge is the sole remaining count from the original New York case.
