Justice Samuel Alito is widely regarded as the most consistently conservative member of the Supreme Court and the justice most likely to side with the Trump administration, according to legal scholars and analysts. Duke University law professor Neil Siegel, in a scholarly analysis published on the university’s law school website, wrote that Alito “is regarded by both his champions and his critics as the most consistently conservative member of the current Supreme Court” and “has become the most important conservative voice on the Court.”
Legal experts at the Supreme Court’s April 2026 hearing on the challenge to Trump’s executive order ending birthright citizenship identified Alito “without hesitation as the justice likeliest to side with President Trump,” The Atlantic reported. The court later ruled against the administration, with Alito dissenting, as MSI previously reported.
Alito wrote the majority opinion in a 6-3 ruling in late June that allowed the Trump administration to turn back asylum seekers at the international border without permitting them to seek asylum, according to the court’s opinion. The decision, which the court issued in the case brought by Al Otro Lado, held that the administration could deny asylum to anyone who had not physically set foot on U.S. soil.
Alito’s influence on the court may be reaching an all-time high, according to a report by Alternet. People who know him say he may not want to jeopardize the chance to have a successor who aligns with his ideology, and is mindful of what unfolded when Justice Ruth Bader Ginsburg died in September 2020, setting off a confirmation scramble that allowed Trump to appoint Justice Amy Coney Barrett, according to the report.
With the 2026 midterms looming, Alito is the lynchpin for conservative legal victories, Internewscast reported. If Democrats lose the Senate, Trump could replace aging justices, but while Alito sits, he provides a reliable vote to restrict federal agency power.
The Daily Beast reported that Alito has evolved to become “one of the most combative, MAGA-friendly figures on the highest court in the land.”
Alito was treated for dehydration in April 2026 after a Philadelphia event but returned to the bench the following Monday, the court said.
