WEC warned postmaster general of ballot delays in May
The lawsuit, filed Friday, argues that voters in the swing state whose absentee ballots do not arrive by Election Day should be allowed to cast provisional ballots at the polls. The filing comes amid growing concerns about how quickly the U.S. Postal Service will be able to deliver ballots ahead of the November midterm elections.
In May, the bipartisan Wisconsin Elections Commission warned the U.S. postmaster general that any delay could deprive citizens of their fundamental right to vote, according to the lawsuit.
Earlier this year, a group of mostly Democratic U.S. senators also wrote the Postal Service, raising concerns that a change in how mail is postmarked could invalidate many mail-in ballots.
Control of Congress is at stake in the November elections, and Wisconsin voters will be electing a new governor as well as determining control of the state Legislature.
