Boardman ruled policy “almost certainly unconstitutional” in 35-page opinion
Trump’s August 6 executive order was directed at people the president alleged enter the country under the guise of tourism while intending to give birth. In her 35-page ruling, Boardman found that the order contradicted the Supreme Court’s prior holding and that the president’s policy “is almost certainly unconstitutional.” Rights groups, including We Are CASA, had challenged the order in court.
Shana Khader, legal director at the Maryland-based group We Are CASA, said the administration “has lost before this court, lost before the supreme court, and lost again today.”
The birthright citizenship order is among several immigration policy initiatives the Trump administration has pursued. Those efforts have included expelling undocumented migrants and removing deportation protections from nationals of more than a dozen countries.
House Democrats move on Supreme Court, war powers
In other developments reported the same day, House Democrats rejected a Republican-proposed constitutional amendment that would have permanently capped the size of the US Supreme Court at nine justices. The proposal, framed by Republicans as a campaign issue ahead of the November midterms, failed 212-206.
Four House Democrats — Gregory W Meeks, Adam Smith, Jim Himes and Bennie G Thompson — introduced a war powers resolution seeking to halt the Trump administration’s boat strikes. The lawmakers said people have been killed “without due process” in attacks never authorized by Congress.
Senator Richard Blumenthal criticized a US Postal Service statement about a new system to screen millions of mail-in ballots for the upcoming midterm elections. Quoting the postal service as having effectively said “just trust us,” Blumenthal said that “is not acceptable.”
Other executive-branch moves reported the same day
Trump celebrated Apple’s decision to rename Lake Ontario to “Lake America” for Maps app users in the United States, fulfilling what Trump described as his request and following an executive order issued amid rising trade tensions between the US and Canada.
The Pentagon introduced guidelines for a mandatory new testosterone deficiency screening required for service members age 30 and older. The policy was introduced by Defense Secretary Pete Hegseth last month.
Trump has also floated the idea of naming the Strait of Hormuz “TRUMP STRAIT,” claiming that the United States has control over the critical waterway despite an escalating conflict with Iran.
